Terms of service

These Terms of Service (the “Terms”) govern your access to and use of On Sees (the “Service”, available at on-sees.com), operated by its individual developer, based in Thailand (the “Operator”, “we”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service lets you mark the regions and cities you have visited on a personal world map, keep a wishlist, optionally share your map with people you choose, and record shared visits with others. The Service is currently provided free of charge. We may add, change, gate, or remove features, and may suspend the Service for maintenance; where a change is material and practicable, we will give notice within the Service.

2. Eligibility

You must be at least 16 years old to use the Service, and legally capable of agreeing to these Terms under the law that applies to you.

3. Accounts

3.1 Kinds of account. You may use the Service signed in with a supported third-party provider (currently Google), or without signing in via an anonymous account tied to your browser. An anonymous account can later be linked to a provider, preserving its data.

3.2 Anonymous accounts are device-bound. Until linked, an anonymous account exists only through your browser’s session. If that session is lost — for example, by clearing browser data — the account and its data cannot be recovered. Link an account to keep your map.

3.3 Handles. Signed-in accounts carry a unique handle (3–20 characters: lowercase letters, numbers, underscore). Certain names are reserved. You may change your handle; a released handle enters a 30-day cooldown before anyone else can claim it. You may not claim a handle to impersonate another person or to squat on a name in bad faith.

3.4 Responsibility. You are responsible for activity on your account and for keeping access to your sign-in provider secure.

4. Your content

4.1 Ownership. The content you add to the Service — your travel data, bio, map title, and avatar (together, “Content”) — remains yours.

4.2 Licence to operate. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and display your Content, solely as needed to operate the Service and only according to the visibility settings you choose. This licence ends when you delete the Content or your account, subject to the limited retention described in the Privacy Policy.

4.3 Your responsibility. You are responsible for your Content and must hold the rights to anything you upload (including your avatar image).

5. Acceptable use

You agree not to:

  • use the Service unlawfully, or post Content that is harassing, hateful, sexually explicit, violent, or that promotes illegal activity;
  • impersonate any person or misrepresent your identity;
  • place links, email addresses, phone numbers, or other contact details in your bio (it is a description, not a contact channel);
  • upload an avatar you lack rights to, or one depicting unlawful content;
  • harass other users — including repeated unwanted invitations; declining an invitation blocks re-invites, and invitations are rate-limited;
  • access the Service by automated means, scrape it, probe or circumvent its security or rate limits, or interfere with its operation.

6. Moderation and enforcement

6.1 Automated screening. Bio text is screened automatically before it is stored (including by an external moderation classifier — see the Privacy Policy); text that fails the check is rejected. If the screening service is unavailable, saving a bio is temporarily disabled rather than allowed through unchecked.

6.2 Reports. Anyone can report a profile via the report option on that profile or by emailing abuse@on-sees.com. We review reports and act on them.

6.3 Enforcement. We may remove Content, restrict features, or suspend or terminate accounts that breach these Terms or create risk for the Service or its users — with notice where practicable, immediately where necessary. Technical safeguards such as rate limits apply to all accounts.

7. Privacy

How we handle personal data — including the in-app tools for exporting and deleting your data — is described in the Privacy Policy, which forms part of these Terms.

8. Third-party services and attribution

Signing in with a third-party provider is subject to that provider’s own terms. The map is built on open data — base map data © OpenStreetMap contributors — and open-source software; the full attributions are listed at Licenses & attributions.

9. Termination

9.1 By you. You may stop using the Service at any time and may delete your account in-app (Account → Delete my account; anonymous accounts: “Forget this device”). Deletion is permanent and immediate, as described in the Privacy Policy.

9.2 By us. We may suspend or terminate your access as described in Clause 6.3, or discontinue the Service itself; if the Service is discontinued we will make reasonable efforts to give prior notice so you can export your data. Clauses that by their nature should survive termination (including Clauses 10–12) survive.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant uninterrupted availability, freedom from defects, or the preservation of data, and we offer no service-level commitment. Travel data is self-reported by users and is not verified by us. You are encouraged to download a copy of your data regularly using the in-app export.

11. Limitation of liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from or in connection with the Service; and the Operator’s total aggregate liability shall not exceed the amount you paid to use the Service (the Service being free, this amount is zero). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for wilful misconduct or gross negligence, or rights you hold as a consumer under mandatory law.

12. Governing law and disputes

These Terms are governed by the laws of Thailand, and disputes are subject to the jurisdiction of the courts of Thailand — without depriving you of the protection of mandatory consumer-protection rules of the country where you reside.

13. Changes to these Terms

We may revise these Terms as the Service evolves. The “Last updated” date above always reflects the current version, and we will take reasonable steps to bring material changes to your attention within the Service before they take effect. Using the Service after a change takes effect constitutes acceptance of the revised Terms.

14. General

If a provision of these Terms is held unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and the Operator regarding the Service.
